Judge Denies Post-Trial Motions in Chip Designers' M&A Row, Bringing Judgment to More Than $41 Million (The Recorder)

A California state judge has denied the post-trial motions filed by chip design software company Silvaco in its long-running earn-out dispute with an international business it acquired in 2018, Nangate Denmark ApS, bringing Nangate's judgment against Silvaco to over $41 million. "Through those motions, Silvaco and the Pesics and their new lawyers basically were asking the court to undo everything that the jury did," said Jennifer Fisher, a Goodwin Litigation partner who led the team representing Nangate along with IP Litigation partner Brett Schuman, in an interview with The Recorder. "They attacked the liability on the contract award as well as contract damages. They attacked the liability findings on the counts, and they heavily contested the punitive damages award." Schuman added, "I just happen to know that ... at 10% per annum post-judgment interest, that there is over $700,000 in interest on the $39.6 million judgment already as of [March 13]. I believe the amount is somewhere around $10,000 per day."
