Andrew Ong is a partner in Goodwin’s Intellectual Property Litigation practice and a leader of the firm’s Trade Secrets, Employee Mobility & Non-Competes group.

Andrew focuses his practice on complex intellectual property issues, encompassing patent disputes and trade-secret litigation. He has extensive experience in litigation within federal courts, as well as proceedings by the United States Patent and Trademark Office, such as inter partes reviews and reexaminations. His work encompasses a diverse range of technology areas, including network devices, design automation software, data storage, and semiconductor chips.

Andrew regularly engages in pro bono work. His recent pro bono activities include filing several FOIA lawsuits on behalf of the ACLU seeking documents relating to language access at immigrant detention center as well as treatment of immigrants by ICE third-party contractors. Andrew also regularly takes on cases, including prisoner § 1983 cases, through the Northern District of California’s Federal Pro Bono Project.

Experience

Representative matters include:

  • Samba TV v. Alphonso Inc. (N.D. Cal.) Represented Alphonso in competitor patent infringement dispute on technology relating to digital ad campaigns on TVs and mobile devices. Achieved summary judgment of non-infringement on behalf of Alphonso in N.D. Cal. On appeal, the Federal Circuit invalidated patent under 35 U.S.C. § 101 based on successful challenge to district court’s prior decision.
  • Applied Materials, Inc. v. Cohen (N.D. Cal.). Defended Applied Materials against claims of infringement for four patents relating to the fabrication of semiconductor devices. The case resulted in a favorable settlement for Applied Materials.
  • ATI v. Parkes (D. Kans.). Represented ATI in copyright infringement lawsuit relating to defendant’s creation of study cards based on ATI’s nursing school materials. The case settled on the eve of trial.
  • Applied Predictive Techs., Inc. v. MarketDial, Inc. (D. Utah). Defended MarketDial in trade-secret misappropriation and patent infringement case relating to business analytics technology. Achieved dismissal of patent claim under 35 U.S.C. § 101 on early motion to dismiss.
  • Netgear Inc. v. Ruckus Wireless Inc. (D. Del.). Secured jury verdict of non-infringement of asserted patents for Ruckus. Worked as part of team that took case over for Ruckus just two months before trial*
  • Gratuity Solutions LLC v. Toast, Inc. (D. Mass.). Currently representing Toast in a patent infringement and breach of contract case. Achieved dismissal of one asserted patent under 35 U.S.C. § 101 on early motion to dismiss.
  • Omnireps LLC v. AddOn Computer Peripherals LLC (N.D. Ill.). Currently representing multiple defendants in lawsuit alleging numerous claims, including trade secret misappropriation, breach of contract, copyright infringement, civil conspiracy, and RICO.
  • Nomadix v. iBAHN (C.D. Cal.). Represented iBAHN Corporation in a multi-patent, multi-defendant patent dispute related to hotel-based internet services*
  • Dynetix Design Solutions, Inc. v. Synopsys, Inc. (N.D. Cal.). Defended Synopsys in patent infringement action relating to software for logic simulation tools. Secured stipulated judgment of non-infringement for Synopsys based on pre-trial motions and claim construction*

Professional Activities

Andrew currently serves on the Board of Directors for the Asian Law Alliance, an organization that focuses on immigration and housing rights. Additionally, he is an active member of several professional associations, including the Asian American Bar Association of the Greater Bay Area, and the Asian Pacific American Bar Association of Silicon Valley.

Professional Experience

Prior to joining Goodwin, Andrew served as a law clerk to the Honorable Jacqueline Scott Corley and to the Honorable Charles R. Breyer, both in the U.S. District Court for the Northern District of California.

Additionally, Andrew worked as a misdemeanor trial attorney at the Public Defender Office for Santa Clara County for a year. In this role, he successfully tried ten cases to a jury verdict and managed a large number of misdemeanor cases, primarily handling pre-trial matters and settlements.
