Biden Administration Merger Challenges: Can the Agencies Turn Around a Losing Record?

The DOJ and FTC under the Biden Administration have taken an aggressive approach to merger enforcement, eschewing consent decree settlements for litigated merger challenges in a number of high profile transactions. But, the agencies have run into a judiciary skeptical of the merits of the agencies’ claims of anticompetitive effects, handing them defeats in Illumina/Grail, UnitedHealth/Change, US Sugar/Imperial, and Booz Allen/Everwatch. Join this session to hear discussion whether the judicial resistance to FTC’s and DOJ’s ambitious enforcement agenda will change the agencies’ approach? Or if the agencies will continue to push the limits of merger enforcement and continue to bring cases that do not hew closely to traditional theories of harm recognized by the courts.

Hot Button Issues for Consumer Protection Enforcement and Litigation in 2023

Consumer protection regulatory, enforcement and litigation action was fervent and near record levels in 2022. With increasing macroeconomic uncertainty, companies should expect consumer protection actions to continue at a rapid pace in 2023, and remain top priorities for regulators, enforcers and class action attorneys. In this session, we will discuss hot button issues for Consumer Protection in 2023. Among regulatory, enforcement and litigation topics we will cover are emerging trends at the federal and state level with:

  • Auto Renewal Laws and subscription services and products
  • Online and social media marketing and advertising and the use of AI and dark patterns
  • Consumer privacy for keystroking technologies, health care and biometrics
  • Telephone Consumer Protection Act (TCPA) and mini-TCPA laws
