Goodwin represented Hotel Tower Owner LP, a joint venture between clients, Boston Properties and Delaware North (collectively, the Hotel Tower Owner), in the leasing of an air rights parcel, comprising a portion of The Hub on Causeway development on the site of the historic Boston Garden, to a unit of citizenM hotels, a Netherlands-based hotelier. The approximately 260 room micro-hotel will be located in a dedicated 10-story tower above a podium building and will be built by citizenM, with Boston Properties Limited Partnership serving as its development manager.
Goodwin has been concurrently representing Boston Properties and Delaware North in their joint venture as developers in Phase 1 of the ongoing Hub on Causeway project, which will include a podium building containing approximately 200,000 square feet of retail space, approximately 175,000 square feet of creative office and loft space, and a new entrance on Causeway Street to the TD Garden and North Station, among other facilities. Phase 2 of the project will include the citizenM hotel, the recently consummated transaction and an adjacent 38-story residential tower containing approximately 440 units, each in a separate tower above the podium. In addition, an office tower with approximately 525,000 square feet, in a separate 21-story tower above the podium, will constitute Phase 3 of the project.
The Goodwin team with respect to the hotel air rights transaction was led by counsel Michael Litchman, who represented Hotel Tower Owner in all negotiations with citizenM, and included associate Reade Everett. Partner Martin Healy, counsel Robert Fitzgerald advised on zoning and permitting issues; partner Ettore Santucci advised on the hotelier’s offshore parent’s guaranty of the lease. Partner Siobhan Murphy and associate Mary McQuinn represented Delaware North in connection with the Hotel Tower Owner joint venture agreement and matters associated with the sale of the air rights parcel from Boston Garden Development Corporation.
