Theresa Sutton is counsel in the firm's Intellectual Property Litigation department focusing on complex commercial litigation. She joined the firm in 2020. Her practice includes counseling, litigating and resolving business disputes with an emphasis on trade secrets, fraud, contracts, and internet-related matters. Theresa’s representative cases include unfair competition, CAN-SPAM, computer hacking, copyright infringement, trade secrets misappropriation, trademark infringement, UNRUH Civil Rights Act violations, unlawful detainer, negligence, fraud, and breach of contract. Theresa has litigated in numerous California Superior Courts and Federal District Courts, as well as arbitration before JAMS. Theresa is familiar with all aspects of litigation and alternative dispute resolution. She leverages her broad litigation experience and collaborative style to achieve cost-effective, successful resolutions for her clients.
Theresa volunteered with the Santa Clara County District Attorney’s Office as a Deputy District Attorney, in the Misdemeanor unit. Theresa investigated and tried misdemeanor cases including DUIs, child endangerment, and fraud.
She also has worked with prominent Silicon Valley companies as part of the in-house legal team, with a focus on both litigation and commercial transactions.
While attending law school, Theresa received the Public Interest Award for her work representing children and families navigating Santa Clara County’s juvenile dependency system.

Professional Activities
Theresa was President of the Board of Directors for the Pro Bono Project of Santa Clara County. She also co-founded Omar’s Dream Foundation, a non-profit focused on bringing education to terminally ill children.
