Wave Of Algorithmic Pricing Laws Crashes Over Rental Market (Law360 Real Estate Authority)

Brian Lerman, a real estate partner at Goodwin, recalls his days in-house at a real estate company when, before software helped landlords set prices, leasing associates would be sent out as "secret shoppers" to ask what rental buildings were charging for rent. Now, with a growing policy backlash toward the practice of using price-setting software, on the grounds of antitrust violations, Lerman said landlords are grappling with how much deference to give their property managers in how they handle pricing. "Property managers are deciding what to allow, how will they handle pricing, and what will they defer to their managers on, whether they use Yardi or RealPage," said Lerman to Law360 Real Estate Authority. "I think where there starts to be questions is what is still permitted. If algorithmic pricing is not, are there ways to get at the same data without it being algorithmic pricing?" Lawmakers at all levels of government are seeking to ban the use of algorithmic pricing tools in the rental housing market and beyond.
