Summary
Nearly half of Americans receive healthcare coverage through employer-sponsored plans, the vast majority of which are governed by ERISA. Recent ERISA class action litigation targeting those healthcare benefits has continued to burgeon in recent years. These class actions challenge the coverage available under employer-sponsored plans, and how healthcare is paid for. Plaintiffs continue to advance new theories to target both healthcare payors and providers. ERISA also provides a mechanism that has been used offensively by players in the healthcare industry to challenge state laws under federal preemption principles.
